GDL strikes: Regional Labour Court makes decision

  • Court prohibits chaotic GDL strikes in school transport
  • Strikes on school trains must be announced at least four days in advance
  • Better planning, but fundamental right to education and safety on the way to school take a back seat to the right to strike

Chemnitz - This afternoon, the appeal hearing on the chaotic GDL strikes in school transport took place at the regional labour court. The Regional Labour Court has confirmed the ruling of the Chemnitz Labour Court in important parts. Uncontrolled strikes by the GDL can thus be averted. The regional labour court has thus given City-Bahn Chemnitz more lead time to organise rail replacement services for school transport.

With the help of the law firm Heuking, City-Bahn Chemnitz has succeeded in having the GDL prohibited from preventing school transport with chaos strikes in the second court instance. This means that on school days, school transport must be guaranteed in the mornings and afternoons - unless the strikes are announced at least four days in advance. With the four-day strike notice period, school transport may therefore be subject to strike action again in future - contrary to the City-Bahn's application. As a result of the consideration, the fundamental right to strike - apart from minor restrictions - is thus categorised higher than the pupils' fundamental right to education and a safe journey to school.
